The work analyzes the issues of digital (electronic) justice and electronic document management in courts. The authors focus on Russian legislation and modern digital technologies governing legal and technological treatment of electronic documents, electronic signatures, electronic archives, and the relevant software related to digital document management in courts. The monograph examines international model laws and principles providing for electronic communications between the court and parties to court proceedings, as well as digital ecosystems. In addition, the work provides an overview of the rules governing legal recognition of digital documents in cross-border transactions, as well as the systems of electronic justice existing in a number of foreign jurisdictions.
The research places special emphasis on the assessment of electronic evidence, together with the use of artificial intelligence and its further development.
This book is the result of a study by the authors of digitalization issues for 2021. At the same time, the digitalization process continues and will be reflected in the further works of the authors.
